Please read these Terms carefully before using Polaris or making any payment. By accessing or using any Polaris service, you agree to be bound by these terms in their entirety.
1. Nature of the Service
Polaris Bot ("Polaris," "the Software," "we," "us") is an automated trading software service. We provide installation, configuration, and operational monitoring for algorithmic trading on compatible broker platforms.
Polaris is not a fund manager, investment advisor, financial planner, or broker-dealer. We do not hold, manage, custody, or control client funds. All capital remains in the client's own broker account under their exclusive ownership. Use of Polaris is a purchase of software access and technical services — not participation in any investment product.
2. Eligibility
By using Polaris, you represent that you are at least 18 years of age, legally capable of entering a binding contract in your jurisdiction, have read and understood the risks of automated cryptocurrency trading, are not a resident of a jurisdiction where such activity is prohibited, and are acting as principal on your own behalf.
3. Risk Disclosure & Forward-Looking Disclaimer
Past results do not guarantee future results. Future trading outcomes are inherently uncertain events that cannot be predicted, guaranteed, or promised by any system, algorithm, or individual.
- Past Data ≠ Future Performance: Historical data reflects what the strategy produced under past market conditions. These conditions will not necessarily repeat.
- No Projection or Promise: No metric, live status, PF, or PnL figure published constitutes a projection or promise of future results.
- Market Unpredictability: Crypto markets are subject to extreme volatility, structural changes, and black swan events no algorithm can fully anticipate.
- Execution Variance: Live data results may vary due to slippage, latency, broker fill rates, market structure, and fees.
- No Leverage Recommended: Polaris does not recommend leverage. Floating drawdown can become a substantial risk when leverage is used.
- No Manual Intervention Recommended: Manually opening or closing positions changes the strategy behavior and may cause the client account to no longer match the published live data record.
- You may lose part or all of the capital in your broker account.
By proceeding, you expressly acknowledge these risks and confirm you are not relying on past performance data as a representation of future results.
4. Data Integrity & Protected Log Timing
While Polaris does not guarantee future results, Polaris does guarantee the fidelity and authenticity of its live and validation performance data. Validation records, live data ledgers, and operational status are faithful, accurate representations of actual strategy execution.
Protected Log Timing: Public performance logs intentionally withhold exact timestamps and calendar dates to protect proprietary timing logic. Public log timing appears as "available upon request."
Live Data Policy: Live data records are published through the Transparency Center with specific timestamps and calendar dates intentionally withheld — solely to protect proprietary timing logic. The underlying trade results, PnL, and sequence are authentic and unaltered.
5. Live Data Integrity & Transparency Standard
Our live data is real. Our validation data is real. Exact log timing is withheld from the public view.
Validation Baseline: Polaris publishes more than one year of live data validation, combining historical candle data and ongoing live-data updates. The first validation candle began on May 20, 2025 at 00:00 UTC with $1,000 initial capital.
Compounding Design: Polaris engines are designed around compounding account growth from a defined initial capital baseline. Compounding can increase both account size and exposure over time. This does not guarantee future returns.
Polaris publishes a transparency standard that, to our knowledge, no other automated trading software provider in this space has publicly matched. We publish live data status, winning and losing trades, Profit Factor (PF), unrealized drawdown (DD Open), realized drawdown (DD Closed), and full trade sequences: entry, exit, and PnL.
Live data and validation data originates from genuine market data and actual strategy execution. Not cherry-picked. Not curve-fitted. While we cannot guarantee future results, we can and do guarantee that the data we share reflects what our system actually did — not what we wish it had done.
6. Stop-Loss Architecture, Exchange-Side Order Placement & Liability Transfer
Every Polaris trade is executed with a Stop-Loss (SL) and Take-Profit (TP) placed directly on the exchange or broker at the moment of entry. This is non-negotiable and core to the Polaris risk architecture.
- Orders remain on the exchange: SL and TP are registered on the exchange's order book — independent of any Polaris server, computer, or internet connection.
- Power outage protection: If your computer shuts down or loses power, your position remains protected. The SL and TP are active on the exchange regardless.
- Internet failure protection: If you or Polaris lose connectivity, your protective orders remain in force on the exchange side.
Liability Transfer: Once a position is opened and its SL/TP orders are confirmed by the exchange, the operational responsibility for that position transfers to the exchange or broker platform. Polaris's responsibility at that point is limited to the software logic that initiated the entry. Slippage, partial fills, gapping, or exchange-side failures fall within the exchange's jurisdiction and terms of service. Polaris is not liable for exchange-side execution outcomes after position entry.
7. API Key Security
Polaris requires trading-only API keys with withdrawal permissions explicitly disabled. You agree to create keys with trading permissions only, never share keys with withdrawal access, revoke access anytime, and not transmit keys via unsecured channels outside the defined onboarding protocol. Polaris will never request API keys with withdrawal access.
8. Fees & Payment
Services are priced by capital tier per polaris-bot.com/pricing. Setup fees are one-time and non-refundable once onboarding commences. During the initial activation rollout, Polaris may accept stablecoin payments for setup and monthly access through the Plug & Play activation desk. Crypto payments are final once confirmed on-chain. Prices may change with 30 days notice.
9. Automatic Tier Upgrades
Polaris pricing is based on connected account capital. If the connected account capital rises into a higher pricing tier, the monthly subscription may move automatically to that higher tier for the next applicable billing period. By activating Polaris and agreeing to these Terms, the client authorizes this automatic tier adjustment.
Capital Growth Notice: If account capital increases, the monthly tier increases automatically. This policy is part of the subscription terms and applies regardless of whether the capital increase comes from deposits, trading performance, or any other increase in connected account value.
10. Limitation of Liability
To the maximum extent permitted by law: Polaris and its affiliates shall not be liable for any trading losses, lost profits, or damages arising from use of the software. Our total aggregate liability shall not exceed fees paid in the 3 months preceding the claim. The software is provided "as is" without warranties of any kind.
11. Absolute Proprietary Rights
Polaris Bot SaaS and its founder, Hector S. Mari Fernandez, hold absolute, unrestricted, and exclusive ownership over all source code, engine logic (Queen, Beast, and any future engines), trading strategies, live data records, validation data, and all derived intellectual output. No payment transfers any ownership interest. Clients receive only a limited, revocable permission to have the software operate on their behalf during their active subscription. These rights are perpetual, irrevocable as against any client, and not subject to negotiation.
12. Termination & Non-Renewal
Clients may cancel at any time by revoking API keys and written notice. Monthly fees already billed are non-refundable. Cancellation stops the next monthly billing cycle and does not create a refund for the current paid cycle.
Unilateral Non-Renewal Right: Polaris reserves the absolute and unconditional right to decline renewal of any subscription once its current paid period concludes — at its sole and exclusive discretion, without obligation to provide any reason, justification, or prior notice. This right is exercised unilaterally and without conditions. No client has any entitlement to continued service beyond their currently paid subscription period.
13. Right of Admission & Access Revocation
Polaris operates as a private, invitation-based software service and expressly reserves the absolute right of admission. Polaris may accept or decline any individual or entity as a client, at any time, for any reason or no reason, without obligation to disclose reasoning. Access is granted as a revocable privilege, not a right. Payment does not create any entitlement to ongoing access beyond the current paid period. By submitting payment, the client acknowledges Polaris holds full discretionary authority over who may use its software and for how long.
14. Governing Law
These Terms are governed by the laws of the jurisdiction where Polaris Bot SaaS is registered. Disputes shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration. You waive the right to participate in class action lawsuits against Polaris.
15. Changes to Terms
Polaris may update these Terms at any time. Material changes will be announced with a minimum 14-day notice period. Continued use after changes take effect constitutes acceptance. Current version always at polaris-bot.com/terms-and-conditions.
